Waste Hub Website Privacy Policy

Waste Hub, LLC (“Waste Hub,” “us,” “our,” and “we”) is committed to protecting the privacy of entities and individuals who visit and browse the waste-hub.com website (the “Website”) (such entities and individuals are referred to as “Visitors”), as well as entities and individuals who register for accounts on the Website (such entities and individuals are referred to as “Customers”). This Privacy Policy describes Waste Hub's information practices in relation to Customers’ and Visitors’ use of the Website. This Privacy Policy also applies to information collected by Waste Hub through offline contacts it may have with Customers and Visitors.

Personal Information may be provided by you to us in several ways, including without limitation, when you contact us through the Website, when you express an interest in obtaining additional information about the services we offer, when you register for an account through the Website, and/or when you sell or purchase waste product, agree to have waste product removed, agree to remove waste product, or otherwise agree to transfer or receive waste product as a result of your use of the Website. In order to engage in any of the foregoing activities, you must provide us your Personal Information. Once you have set up an account on our Website, we may also collect Personal Information about you from third parties, such as credit bureaus, as discussed in Section 4 above and only in accordance with applicable law. 

We use Personal Information of Customers and Visitors to perform the services requested. For example, if you email us and request information or ask a question, we will use the Personal Information provided to contact you about your interest or to answer your question. We may also use your Personal Information to contact you regarding your account and use of the Website and services provided through the Website. We use your Personal Information to help facilitate Transactions, such as the purchase of waste product from another user of the Website. We also may use your Personal Information to collect fees and enforce this Privacy Policy and our Website Terms of Use and the other terms of use and policies incorporated into our Website Terms of Use (our Website Terms of Use are available here: Terms of Use). We use financial information solely to collect payment for our services.

We may also use Personal Information of Customers to contact our Customers for marketing purposes. For example, we may use your Personal Information to contact you to further discuss your interest in our services and to send you information regarding Waste Hub, such as information about promotions, events, or waste-related technology. We may also send you information regarding available waste products of certain of our Website Posters who have hired us to perform marketing services on their behalf. At any time, you may request that we stop contacting you for marketing purposes. In such event, however, we reserve the right to contact you for purposes relating to your use of the Website.

Waste Hub uses one or more third-party intermediaries to manage credit card and other payment processing. These intermediaries are not permitted to store, retain, or use financial information or your other Personal Information except for the sole purpose of processing your payments due to Waste Hub, in accordance with our Website Terms of Use. All of the third parties described above are not authorized to use your Personal Information for any purpose other than as described above and are required to keep the Personal Information confidential.

We may transfer any and all Personal Information and Anonymous Information to a third party in the event of a sale or transfer of assets or other disposition of all or any portion of our business. We will make reasonable efforts to notify you when your Personal Information and Anonymous Information is transferred to any third party under this paragraph by posting such notice on the Website and by contacting you via the Personal Information you have provided us, if any. Unless you consent otherwise, your Personal Information will remain subject to the promises made in this Privacy Policy even after the transfer. But any Personal Information and Anonymous Information you provide after the transfer will likely be subject to a new privacy policy, and you should review that privacy policy.

Notwithstanding anything to the contrary in this Privacy Policy, Waste Hub reserves the right to disclose your Personal Information and Anonymous Information, without your consent and without notice to you, if we reasonably believe we are required by law, judicial proceeding, court order, or legal process to do so; if we reasonably believe that disclosure is necessary to protect, establish, or exercise our rights or defend against legal claims; or if we reasonably believe that disclosure is necessary to protect our other Customers or Visitors or our employees, property, or business.

Unfortunately, no data storage system or system of transmitting data over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of our servers or any Personal Information provided to us in connection with your use of the Website.

  1. Your Agreement to this Privacy Policy. Please read this Privacy Policy carefully before you use the Website. When you use the Website, you signify that you have read, understand, and agree with all of the terms and conditions of this Privacy Policy. If you register for an account on the Website, you will also be required to click-to-agree to this Privacy Policy. If you are acting on behalf of an entity, you represent and warrant that you have full authority to bind your entity to this Privacy Policy. If you do not have such authority or if you do not agree to all of the terms and conditions of this Privacy Policy, do not use the Website. You agree that this Privacy Policy is supported by reasonable and valuable consideration, the receipt and sufficiency of which are hereby acknowledged. Without limiting the generality of the foregoing, you acknowledge that such consideration includes your use of the Website to buy, sell, get paid to receive or remove, pay to have removed, or otherwise provide or receive waste product as a result of your use of the Website and/or your other use of the Website.
  2. Definitions.Customers and Visitors may at times be referred to individually in this Privacy Policy as “you.” Customers may at times be referred to individually as a “Poster” or “Receiver.” The term “Poster” means any user who sells or offers to sell, pays or offers to pay to have removed, allows or offers to allow a Receiver to remove for no payment to the Receiver, or otherwise provides to any Receiver waste product that the Poster posts to the Website. The term “Receiver” means any user who purchasers or offers to purchase, is paid to receive or remove or offers to receive or remove in exchange for payment, removes or offers to remove at no cost to the Poster, or otherwise receives from a Poster waste product that is posted to the Website. Throughout this Privacy Policy, unless otherwise specifically indicated, when we say “use of the Website” (or a similar phrase), this “use” includes visiting and browsing the Website, using any features of the Website made available to Visitors who do not have accounts, and/or logging into your account on the Website and using features made available to Customers with accounts. The term “Transaction(s),” as used in this Privacy Policy, means buying, selling, or otherwise providing or receiving waste product to or from another Website user with or without a monetary exchange, as a result, directly or indirectly, of information posted on the Website.
  3. Modification to this Privacy Policy. We reserve the right to update and revise this Privacy Policy at any time. We will post any new or revised Privacy Policy here, and you should review this Privacy Policy regularly to make sure that you are aware of its terms. You can determine if this Privacy Policy has been revised since your last visit to the Website by referring to the effective date at the top of this Privacy Policy. Waste Hub will also provide notification of significant changes to this Privacy Policy through the Website. In addition, if changes are significant andif you have registered for an account on the Website, we will also notify you of such changes either (i) via the Personal Information (defined below) that you have provided to us; or (ii) by requiring that you agree to the revised Privacy Policy the next time you log in to your account. Your use of the Website following such updates or revisions to this Privacy Policy constitutes your acceptance of and agreement to the terms of this Privacy Policy, as updated or revised by us. The updates or revisions to this Privacy Policy will apply to the Personal Information and Anonymous Information (defined below) collected on and after the date on which we post the updated or revised Privacy Policy; provided, however, that for your obligations in Section 7 of this Privacy Policy, the version of Section 7 in effect on the date that a Transaction between you and another Website user is initiated, will continue to apply to such Transaction, even if Section 7 is later changed. For purposes of the foregoing sentence, a Transaction is “initiated” when a Receiver expresses interest in buying, being paid to remove, or otherwise receiving waste product from a Poster, and the Poster initially engages in a negotiation with the Receiver with regard to the potential Transaction. We will keep prior versions of this Privacy Policy in an archive for your review upon request.
  4. Personal Information Collected. Personally-identifiable information that we may collect includes information such as (i) your name, home or business address, email address, telephone number, fax number, and other information that could be used to contact you or identify you personally; (ii) details regarding your entity; (iii) your financial information, such as your credit card and debit card numbers and bank routing and account numbers; (iv) additional information we may ask you to submit to authenticate yourself, such as answers to security questions to help verify your identity; (v) other supplemental information we obtain from third parties, such as credit check information and other information about you obtained from a credit bureau, as permitted by law; and (vi) information regarding waste product you post to the Website, except for information that you make viewable by all other Website users who have accounts or information that you make available to third parties without confidentiality restrictions. Our treatment of information regarding your waste products and Transactions in which you engage through the Website is discussed in Section 7 below. The foregoing types of information are hereafter collectively referred to as “Personal Information.”
  5. Non-Personally Identifiable Information Collected. As you navigate and browse the Website, Waste Hub automatically collects and stores information about your visit to and use of the Website, such as (i) the date and time of your visit, (ii) the duration of your visit, (iii) the type of browser and browser language you use, (iv) your Internet Protocol (“IP”) address, (v) the actions you take on the Website (such as the web pages viewed and the links clicked), (vi) the websites (if any) from which you linked to the Website, and (vii) keywords and phrases you used to find the Website, if any. All non-personally identifiable information is referred to in this Privacy Policy as “Anonymous Information.” We collect Anonymous Information through the use of commonly-used information-gathering tools, such as cookies and web beacons, which are discussed in more detail below.
  6. Collection and Use of Personal Information. In order to use certain features of the Website, or to otherwise participate in the services we offer, you will be asked to provide Personal Information. YOU DO NOT HAVE TO PROVIDE US WITH YOUR PERSONAL INFORMATION TO BROWSE CERTAIN LIMITED AREAS OF THE WEBSITE, AND WE ONLY COLLECT YOUR PERSONAL INFORMATION FROM YOU WHEN YOU VOLUNTARILY PROVIDE IT TO US. YOU ARE NEVER UNDER ANY OBLIGATION TO PROVIDE YOUR PERSONAL INFORMATION TO US. However, if you do not provide your Personal Information, you will not be able to register for an account and you will not be able to use certain features of the Website. When you do provide us your Personal Information, you are authorizing us to use that information in accordance with the terms and conditions of this Privacy Policy, and you consent to the storage of your Personal Information on our servers located in the United States and elsewhere in the world.
  7. Collection and Use of Anonymous Information.Waste Hub uses commonly-used information-gathering tools, such as cookies and web beacons, to collect Anonymous Information as you navigate the Website. This Section 8 describes in further detail the types of Anonymous Information we may collect and how we may use this Anonymous Information. Waste Hub uses Anonymous Information to operate and improve the Website. We may also use Anonymous Information to track what Visitors to and Customers of the Website are looking at most frequently so we can recognize and deliver more of the desired features and services. We may also combine Anonymous Information with Personal Information about Customers, such as to provide personalized information about us to such Customers. We also may use both Personal Information and Anonymous Information to help diagnose problems with the Website, to analyze statistical use patterns and demographic data, and to improve our services.

    There are two types of cookies: Session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. If you have chosen to identify yourself to Waste Hub, we use session cookies containing encrypted information to allow us to uniquely identify you. Each time you log into your account on the Website, a session cookie containing an encrypted, unique identifier that is tied to your account is placed on your browser. These session cookies allow us to uniquely identify you when you are logged into your account on the Website, and to process your online transactions and requests. Session cookies are required to use your account.

    Persistent cookies remain on your computer after you close your browser or turn off your computer. Waste Hub uses persistent cookies to identify browsers that have been used to previously visit the Website. When you set up an account on the Website or otherwise provide us with Personal Information, a unique identifier is assigned you. This unique identifier is associated with a persistent cookie. We are aware that the information stored in persistent cookies needs to be maintained securely and confidentially. For example, we do not store account numbers or passwords in persistent cookies.

    We may use cookies to remember your personal settings, pre-fill forms for you, and to monitor your use of the Website to improve the services and the Website. We may use information from session and persistent cookies in combination with Personal Information of Customers to provide such Customers with information about us and our services.

    Most browsers automatically accept cookies, but you may be able to disable the acceptance of cookies at any time by changing the preferences in your browser. Most browsers also allow you to change the settings to require that the browser notify you when you receive a new cookie. If you disable your web browser’s ability to accept cookies, you will be able to browse certain limited pages of the Website, but you will not be able to successfully use an account on the Website or use various other features of the Website.

    1. Cookies. Waste Hub uses a feature of your Internet browser called “cookies” to make your interactions with the Website easy and meaningful. When you visit the Website, Waste Hub’s servers send a cookie to your computer. The cookie is placed on your hard drive, and it assigns your computer a unique, random number that acts as a sort of anonymous ID. Standing alone, cookies do not personally identify you; rather, a cookie identifies the computer you use to access the Website. A cookie cannot read data off of your hard drive. Unless you choose to identify yourself to Waste Hub, such as by opening an account, you remain anonymous to us when browsing the Website; the cookie alone will not allow us to identify you personally.
    2. Web Beacons. Waste Hub uses web beacons alone or in conjunction with cookies to compile information about Customers and Visitors’ usage of the Website, as well as their interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as when you viewed a particular website tied to the web beacon and a description of a website tied to the web beacon. For example, Waste Hub may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to the Website. Waste Hub uses web beacons to operate and improve the Website and email communications. Waste Hub may use information from web beacons in combination with Personal Information about Customers to provide such Customers with information about us and our services.
    3. IP Addresses. When you visit the Website, we collect your Internet Protocol (“IP”) address to track and aggregate Anonymous Information. For example, Waste Hub uses IP addresses to monitor the regions from which Customers and Visitors navigate the Website. Waste Hub also collects IP addresses from Customers when they log into the Website in order to confirm the applicable Customer’s identity.
    4. Third Party Cookies and Website Analytics. From time-to-time, Waste Hub may engage third parties to track and analyze usage and volume statistical information from Visitors and Customers of the Website. You may encounter cookies from these third parties on certain pages of the Website, which we have allowed. Waste Hub may also use other third-party cookies to track the performance of our advertisements. The information provided to these third parties does not include Personal Information; rather, we only provide Anonymous Information. This information may be re-associated with your Personal Information after we receive it back from the third parties, but, again, the third parties do not receive your Personal Information. Further, these third-parties are not authorized to use your Anonymous Information in any way other than as described herein and are required to keep the information confidential
  8. Customer Names and Testimonials. Waste Hub may post a list of Customers and testimonials on the Website; however, Waste Hub obtains the consent of each Customer prior to posting any Customer information on such a list or posting testimonials.
  9. Sharing of Information Collected. We may share Personal Information about Website users with our agents so that these agents can contact such Website users who have provided contact information on our behalf to perform certain services for us, such as past-due bill collection, to perform certain marketing on our behalf, and/or so the agents can perform website analytics services, as described above. Waste Hub does not share, sell, rent, or trade Personal Information with third parties for such third parties’ own promotional purposes.
  10. Correcting and Updating Your Information. You may update or change your Personal Information by editing the information associated with your account or by sending us an email request to info@waste-hub.com. If you request that your Personal Information be changed, we may still maintain your preexisting Personal Information for purposes of recordkeeping and to comply with our retention policy described below.
  11. Intended Users of the Website. The Website is intended for adults only. By accessing, browsing, creating an account through, or otherwise using the Website, you affirm that you (i) are eighteen (18) years old or older, or that you are between the ages of thirteen (13) and seventeen (17) and possess legal parental consent or guardian consent to use the Website and provide information through the Website; and (ii) have authority to agree to this Privacy Policy and are competent and capable of understanding and complying with this Privacy Policy. The Website is not directed at children under the age of thirteen (13). Waste Hub does not and will not knowingly collect Personal Information of anyone under age thirteen (13) through the Website. Waste Hub does not and will not knowingly permit submission of Personal Information by anyone under age thirteen (13) through the Website. Waste Hub does not and will not knowingly contact children under age thirteen (13) for marketing purposes. Waste Hub will not knowingly sell or facilitate the sale of products or services to children under age thirteen (13).
  12. Security. Waste Hub uses commercially-reasonable physical, electronic, and managerial security measures to assist in protecting against the loss, misuse, unauthorized access to, and alteration of Personal Information that is under our control. For example, Waste Hub uses Secure Socket Layer (“SSL”) technology to protect your Personal Information using both server authentication and data encryption. These technologies help ensure that your Personal Information is safe, secure, and only available to you through use of your username and password. Waste Hub also hosts the Website in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders.
  13. Retention and Storage. We may retain Personal Information and Anonymous Information in our databases in accordance with any existing document retention policies and applicable laws. This period may extend beyond your relationship with us, but it will be only as long as is necessary, in our discretion, to collect any fees owed; to comply with any applicable law, rule, regulation, or guideline; to prevent fraudulent activity; to enforce this Privacy Policy, our Website Terms of Use, and/or any terms of use or policies incorporated therein; to resolve disputes; to protect ourselves against liability; and to allow us to pursue available remedies and limit any damages we may sustain. Also, we may retain Personal Information and Anonymous Information beyond the end of your relationship with us if we believe in good faith that a law, regulation, rule, or guideline requires it.
  14. Links. This Privacy Policy applies only to Personal Information and Anonymous Information collected through the Website. The Website may contain links to other websites that are not owned or controlled by us (“Linked Sites”). We are not responsible for and have not reviewed the privacy practices of the Linked Sites, or the owners or operators of the Linked Sites. The owners and operators of the Linked Sites may have their own policies regarding privacy and security. We advise you to review any Linked Sites for their own privacy practices to determine what information about you may be collected and used when you use such Linked Sites.
  15. Severability. If any part of this Privacy Policy is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Privacy Policy shall continue in full force and effect.
